Between Nov. 18 and 23, Gardner mailed 18 notices to residents who had not shoveled their walks. All the notices were complaint based. No fines were levied. Ordinance No. 2534 was passed on Dec. 5, 2016 and requires property owners to removes snow and ice within 48 hours from the time a snow or ice storm stops.
During last week’s snow storm, several residents complained about properties with uncleared walks. When the city receives a complaint regarding an uncleared sidewalk, an inspection of the property is completed by the code compliance inspector, according to Daneeka MarshallOquendo, Gardner public information officer. If the property is found to be in violation, then a notice listing the violation found, corrective action necessary and penalty description are mailed to the owner or tenant of the property.
The city determines who owns property through the Johnson County AIMS mapping system, or if a rental, tenants are located through utilities. Violation notices are sent by mail. After the initial notice, property owners are given 48 hours to comply.
If corrective action is not taken, the penalty for violation is considered a municipal offense, and the violator is fined $25 for the first offense, $50 for the second offense and $75 for any subsequent offense. Each continuing 48hour period of a violation is considered a separate offense.
There is no provision in the city’s code that addresses a circumstance where the property resident is elderly or disabled.
“However, the city is currently reviewing programs used in other area cities to connect residents in need with community volunteers,” said MarshallOquendo. Any possible liability concerns will need to be determined before a city sponsored volunteer program can be started. “We’re also reaching out to other community organizations to see if they have programs currently in place to assist those in need,” she said.
Of the complaints Gardner received, one complaint was located in the county, and the city code cannot be enforced on county properties.
With both vacant or commercial property, the owner is still responsible to clear walks. Complaints about property owned by USD 231 should be directed to the school district.

Standard Snow Removal Schedule & Policy
If ice or only light snow occurs (less than 2 inches), and street plowing is not required, city trucks will spot-treat with materials only.
Priority 1: Thoroughfares & Arterial roads: Plowed by single-axle dump trucks continuously during snowfall.
Priority 2: Collector & Main-line Residential roads: Plowed by single-axle dump trucks continuously during snowfall.
Priority 3: Local Residential Streets: Plowed after Priority 2 is completed and after snowfall has ended.
Priority 4: Cul-de-sacs: Plowed after snowfall and after Priority 2 and Priority 3 streets are cleared.
Additional Snow Removal Policy:
Private streets are maintained by applicable property owners.
• The City of Gardner does not plow sidewalks or driveways unless part of city-owned property.
• Driveways may be blocked during snow removal operations; we attempt to minimize this as much as possible. However, property owners are responsible for clearing their driveways. Residents can minimize this by shoveling snow to the right of their driveway opening.
• Residents are reminded to remove parked vehicles from the roadway. Snow removal is more thoroughly accomplished if vehicles and other equipment are removed from the road. Vehicles on roadways may be towed if they impede normal snow removal operations.
• Residents are also reminded to remove portable basketball goals from the roadside during inclement weather.
• City equipment will not be used to conduct privately-owned vehicle recovery operations.
• City does not have designated emergency snow routes.
• Medical emergencies are referred to 911 for validation.
