NOTICE OF PUBLIC HEARING FOR

ISSUANCE OF INDUSTRIAL REVENUE BONDS

Public notice is hereby given that the City Council of the City of Olathe, Kansas (the “City”), will conduct public hearings on Tuesday, August 2, 2022, at 7:00 p.m., or as soon thereafter as may be heard, at Olathe City Hall, 100 East Santa Fe, Olathe, Kansas, regarding (i) the proposal to amend Resolution No. 17-1009 in order to increase the aggregate amount of the industrial revenue bonds issued by the City in a principal amount not to exceed $240,000,000 and an exemption from ad valorem taxation for property constructed or purchased with the proceeds of such bonds, and (ii) the proposed issuance by the City of its industrial revenue bonds in the principal amount of not to exceed $88,739,000 and in regard to an exemption from ad valorem taxation for property constructed or purchased with the proceeds of such bonds.

Such bonds are proposed to be issued under authority of K.S.A. 12 1740 et seq., as amended, to provide funds for acquiring, purchasing, constructing, reconstructing, installing and equipping, respectively, of (i) the conversion of the existing manufacturing and distribution facility into an office facility, and (ii) the conversion of the existing manufacturing, engineering and warehousing facilities (commonly known as the “Tower” and “Building 1”) into high-tech laboratories, an industrial workshop for research and development, and administrative offices, all located at approximately 151st Street and Ridgeview in Olathe, Kansas. The City intends to enter into a base lease for the facility and further intends to lease the facility to Garmin International, Inc., a Kansas corporation (the “Company”), or its successors and assigns.

The Company has requested a 10-year maximum 75% property tax abatement for the property constructed or purchased with the proceeds of the bonds. This abatement request complies with the City’s tax abatement policy.

A copy of this Notice, together with a copy of the resolutions of intent of the City to be considered for adoption, indicating the intent of the governing body of the City to issue such series of bonds, and reports analyzing the costs and benefits of such property tax exemptions are on file in the office of the City Clerk and available for public inspection during normal business hours.

All persons having an interest in this matter will be given an opportunity to be heard at the time and place above specified.
