NOTICE OF HEARING ON SPECIAL USE PERMIT

NOTICE is hereby given that the PLANNING COMMISSION OF THE CITY OF OLATHE, KANSAS, will hold a Public Hearing at its regular meeting in the Council Chamber of City Hall, 100 E. Santa Fe, Olathe, Kansas, on the 8th day of August 2022, at 7:00 PM, at which time and place you may be heard in regard to the Special Use Permit of the following described property situated in the City of Olathe, Johnson County, Kansas:

ALL OF THAT PART OF THE SOUTHWEST QUARTER (SW1/4) OF SECTION 12, TOWNSHIP 13, RANGE 23 DESCRIBED, AS FOLLOWS:

BEGINNING AT A POINT AT WHICH R.M. PELTIER HAS SET AN IRON BAR AT THE SOUTHWEST CORNER OF THE NORTH HALF (N1/2) OF THE SOUTHWEST QUARTER (SW1/4) OF SAID SECTION WHICH IRON BAR IS 1299.31 FEET NORTH OF AN IRON BAR SET BY OTHERS IN THE SOUTHWEST CORNER OF SAID SECTION; THENCE NORTH 1299.31 FEET TO AN IRON BAR SET BY R.M. PELTIER AT THE NORTHWEST CORNER OF THE SOUTHWEST QUARTER (SW1/4) OF SAID SECTION; THENCE EAST ALONG THE CENTER LINE OF SAID SECTION 2651.95 FEET TO AN IRON BAR SET BY R.M. PELTIER AT THE NORTHEAST CORNER OF THE SOUTHWEST QUARTER OF SAID SECTION; THENCE SOUTH ALONG THE CENTERLINE OF SAID SECTION A DISTANCE OF 1312.6 FEET TO AN IRON BAR SET BY R.M. PELTIER AT THE SOUTHEAST CORNER OF THE NORTH HALF (N1/2) OF THE SOUTHWEST QUARTER (SW1/4) OF SAID SECTION; THENCE WEST ALONG THE SOUTH LINE OF THE NORTH HALF (N1/2) OF THE SOUTHWEST QUARTER (SW/14) A DISTANCE OF 2655.83 FEET TO THE POINT OF BEGINNING, EXCEPT THAT PART LYING EASTERLY OF THE WESTERLY LINE OF THE TRACT CONVEYED TO JOHNSON COUNTY PARKS AND RECREATION DISTRICT FILED AS DOCUMENT NO. 1724598 IN VOLUME 2628 AT PAGE 551, AND ALSO EXCEPT THE NORTH 92 FEET CONVEYED TO HELEN R. SORKIN TRUSTEE UNDER REAL PROPERTIES TRUST AGREEMENT BY DEED FILED AS DOCUMENT NO. 1799080 IN BOOK 2812 AT PAGE 447, SAID LAND BEING IN THE CITY OF OLATHE, JOHNSON COUNTY, KANSAS.

Owners request a Special Use Permit for: Electrical Substation

Location or Vicinity:  10859 S. Woodland Road

If, however, a protest against such special use permit be filed in the office of the City Clerk within fourteen (14) days after the date of the conclusion of the Public Hearing pursuant to said publication notice, duly signed and acknowledged by the Owners of twenty (20) percent of the total area, excepting public streets and ways, located within two hundred (200) feet, within the city limits, or one thousand (1,000) feet, within the unincorporated area, of property proposed to be Rezoned, such rezoning shall not be passed except by at least three-fourths (3/4) vote of all of the members of the City Council.

This Notice shall be published once in the official City Newspaper at least twenty (20) days prior to the date of said Public Hearing.
