BOARD OF EDUCATION
UNIFIED SCHOOL DISTRICT NO. 231, JOHNSON COUNTY, KANSAS
RESOLUTION
WHEREAS, the Board of Education has determined that it is necessary to acquire land for the purpose of constructing school attendance facilities and related facilities; and
WHEREAS, pursuant to K.S.A. 72-8212(e) and K.S.A. 72-8212a(c), the Board of Education may acquire real property for school purposes by exercising the power of eminent domain.
NOW THEREFORE, BE IT RESOLVED by the Board of Education of Unified School District No. 231, Johnson County, State of Kansas, as follows:
1. The Board of Education does hereby find and determine that it is necessary for it to exercise its lawful power of eminent domain in order to acquire three separate parcels of land, comprising approximately 5.56 acres, 8.95 acres, and 8.83 acres, respectively, as depicted on the attached site plan and designated thereon as “Detention Tract,” “Future Parking Lot and Green Space,” and “Proposed Soccer Fields,” situated in the South Half of the Southwest Quarter of Section 23, Township 14, Range 22, in the City of Gardner, Kansas, in order to construct school attendance facilities and related facilities.
2. Unified School District No. 231, acting by and through its Board of Education, intends to acquire fee simple title to said land by exercising its power of eminent domain pursuant to Kansas statutes.
3. The Superintendent of Schools is hereby authorized and directed to employ a competent engineer to make a survey of said land and provide a correct legal description of said land.  Upon completion of the survey and the legal description, said engineer shall file the survey and legal description with the Clerk of the Board.
4. This resolution shall be published once in a newspaper having general circulation in Unified School District No. 231.
