ORDINANCE NO. 2347 AN ORDINANCE VACATING A RIGHT-OF-WAY EASEMENT ON A PORTION OF LOT 1, AND A PORTION OF LOT 2, BOTH IN BLOCK 32, GARDNER LAKE PARK IN JOHNSON COUNTY, KANSAS. NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GARDNER, KANSAS: SECTION 1:  The Governing Body of the City of Gardner, Kansas, deems it advisable and does hereby vacate a right-of-way easement as follows:  The northwest 50’ of Lot 1, Block 32, GARDNER LAKE PARK, a subdivision in Johnson County, Kansas, and the southeast 23’ of Lot 1, Block 32, GARDNER LAKE PARK, a subdivision in Johnson County, Kansas, and the north 45’ of Lot 2, Block 32, GARDNER LAKE PARK, a subdivision in Johnson County, Kansas; of the following described easement as recorded at the Johnson County Office of Records and Tax Administration, in Miscellaneous Book 196, Page 194: The easement hereby granted shall be the Westerly 10 feet along the front line of Lots 3 and 4, Block 32, Gardner Lake Park, a subdivision of Johnson County, Kansas, and 5 feet on either side of a line commencing at the west property line at the point of a dividing line that divides Lots 2 and 3, Block 32, Gardner Lake Park, a subdivision in Johnson County, Kansas; thence North 28 degrees 40 minutes West through Lots 2 and 1, Block 32, Gardner Lake Park, a subdivision of Johnson County, Kansas, a distance of 200 feet. SECTION 2:  The City Clerk of the City of Gardner, Kansas, shall cause this Ordinance to be published in the official city paper and to file a certified copy with the County Clerk and the Office of Records and Tax Administration, Johnson County, Kansas. SECTION 3:  These requirements shall apply after the effective date of this ordinance. SECTION 4:  This ordinance shall take effect and be in force from and after its passage, approval, and publication as provided by law. PASSED and APPROVED this 20th day of September, 2010.
