ORDINANCE NO. 2375 AN ORDINANCE AMENDING CHAPTER 12.10, STREET IMPROVEMENTS AND MINIMUM STANDARDS, OF THE CITY OF GARDNER CODE. THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GARDNER, KANSAS: SECTION ONE: Section 12.10.030 be deleted in its entirety and replaced with the following: 12.10.030 Plans and specifications – Cost of inspection. Prior to City issuance of a permit for construction of public infrastructure improvements (to include, but not limited to, public streets, sidewalks, storm drainage, grading, street lights, water, and sanitary sewer), the developer shall deposit with the City of Gardner a performance and maintenance bond in an amount approved by the City Engineer based on construction costs provided by the developer’s contractor as a guarantee that the said public infrastructure improvements will be completed within a period not to exceed one year in complete conformance with all provisions and requirements. The bond shall be in the amount of 100 percent of the construction cost and guarantee the work for a period of two years from the date of issuance of the project completion certificate. SECTION TWO: Section 12.10.040 be deleted in its entirety and replaced with the following: 12.10.040 Plans and Specifications – Cost of Inspection. Any person, firm, partnership or corporation desiring to construct public infrastructure (to include, but not limited to, public streets, sidewalks, storm drainage, grading, street lights, water, and sanitary sewer) within the City of Gardner shall first submit plans and specifications to and obtain the approval of the City Engineer. General plan requirements, plan submittal procedurals, and design criteria are established in the current edition of the Technical Specifications for Public Improvements for Gardner Kansas. 1. Fees shall be established by resolution and shall be payable to the City of Gardner as follows: a. Plan review fees shall be paid upon submittal of plans for first review. b. Inspection fees for all public infrastructure, except sanitary sewer, shall be paid prior to the issuance of a construction permit for said improvements. The person, firm, partnership or corporation desiring to construct sanitary sewer within the City of Gardner must provide full time inspection per Kansas Department of Health and Environment requirements in lieu of payment of an inspection fee. 2. The required performance and maintenance bond for public infrastructure improvements (GMC 12.10.030) shall be submitted to the City of Gardner prior to the issuance of a construction permit for said improvements. SECTION THREE: This Ordinance shall take effect and be in force on January 1, 2012, after its passage by the City Council and publication in the official City Newspaper.
